PRIVACY POLICY

OBJECTIVE: Establish criteria for the collection, storage, use, circulation, and deletion of personal data processed by ETNICO S.A.S, as the data controller. ETNICO S.A.S. will use the information for the following purposes:

1. Conduct activities for the development of ETNICO S.A.S.'s corporate purpose concerning the fulfillment of the contract with the data subject.
2. Send invitations to events and offer new products and services.
3. Manage requests, complaints, or claims.
4. Conduct satisfaction surveys regarding goods and services offered by ETNICO S.A.S., acting as the data controller.
5. Provide contact information to its sales force and/or network of distributors, telemarketing, market research, and any third party with which ETNICO S.A.S. has a contractual relationship for the development of such activities [market research, telemarketing, etc.] or for their execution.
6. Contact the Data Subject via telephone for surveys, studies, and/or confirmation of personal data necessary for the execution of a contractual relationship.
7. Contact the Data Subject via electronic means [SMS or chat] for sending news related to loyalty campaigns or service improvement.
8. Contact the Data Subject via email for sending statements, account statements, or invoices related to obligations arising from the contract between the parties.
9. Fulfill the obligations contracted by ETNICO S.A.S. with the Data Subject regarding the payment of salaries, social benefits, and other remunerations established in the employment or service contract, or as required by law.
10. Transfer personal data collected within the country to affiliated companies of ETNIKO SAS to comply with applicable anti-money laundering regulations.
11. Transmit personal data outside the country to third parties with whom ETNICO S.A.S. has signed a data processing contract and is necessary for the fulfillment of the contractual purpose.
12. Provide the services offered by ETNICO S.A.S. and accepted in the signed contract.
13. Provide information to third parties with whom ETNICO S.A.S. has a contractual relationship and is necessary to fulfill the contracted purpose.

SCOPE: This policy applies to all personal information registered in the databases of ETNICO S.A.S., acting as the data controller.

OBLIGATIONS: This policy is mandatory and strictly enforced for ETNICO S.A.S., its administrators, employees, contractors, and collaborators in general.

DATA CONTROLLER: ETNICO S.A.S. is a legally constituted commercial entity by private document dated August 1, 1995, in Barranquilla, registered in the commercial registry of the Chamber of Commerce of Barranquilla on August 1, 1995, in Barranquilla, with tax identification number 802.001.100-2.

DATA SUBJECT RIGHTS: As the data subject, you have the right to: (i) Access the processed data for free; (ii) Know, update, and rectify your information against partial, inaccurate, incomplete, fragmented data, leading to error, or those whose processing is prohibited or unauthorized; (iii) Request proof of the granted authorization; (iv) File complaints with the Superintendency of Industry and Commerce (SIC) for breaches of current regulations; (v) Revoke the authorization and/or request the deletion of data, provided there is an explicit request to that effect; (vi) Refrain from answering questions about sensitive data. Responses regarding sensitive data or data of minors and adolescents will be optional.

ATTENTION TO REQUESTS, INQUIRIES, AND CLAIMS: The customer service department is responsible for processing requests from data subjects to enforce their rights.

PROCEDURE FOR THE EXERCISE OF THE RIGHT TO HABEAS DATA: In compliance with data protection regulations, ETNICO S.A.S. outlines the procedure and minimum requirements for exercising your rights.

For the submission and processing of your request, we ask you to provide the following information:
1. Full name; 2. Contact details [physical and/or electronic address and contact numbers]; 3. Means to receive a response to your request; 4. Reason(s)/fact(s) giving rise to the claim with a brief description of the right you wish to exercise [know, update, rectify, request proof of authorization, revoke, delete, access information]; 5. Signature [if necessary] and personal identification number [citizenship card, identity card, foreigner identification card, or passport number].

The maximum term set by law to resolve your claim is fifteen (15) business days, counted from the day following its receipt. If it is not possible to address the claim within this term, ETNICO S.A.S. will inform the interested party of the reasons for the delay and the date on which the claim will be addressed, which in no case may exceed eight (8) business days following the expiration of the initial term.

Once the terms established by Law 1581 of 2012 and other regulations that regulate or complement it have been fulfilled, the Data Subject to whom the exercise of the rights of access, updating, rectification, deletion, and revocation is denied, in whole or in part, may bring the case to the attention of the Superintendency of Industry and Commerce [Delegation for the Protection of Personal Data].

The databases in which personal data will be recorded will be valid until the Data Subject expressly requests the data controller to revoke the authorization and/or request the deletion of the data, and there is no legal obligation to retain the information.

Clause on Content and Typographical Errors:

ETNICO SAS reserves the right to modify the commercial offer presented on the website (changes to products, prices, promotions, and other commercial and service conditions) at any time. We make every effort to present the information on the website truthfully and without typographical errors. However, in the event of an error or errors in the systems, beyond the control of ETNICO SAS, immediate correction will be made. If a client has made a purchasing decision based on such an error, we will communicate the error to the client, and ETNICO SAS has the right to deny or cancel any order generated for those products. If the customer's credit or debit card has already been charged, and the order is canceled for the aforementioned reasons, ETNICO SAS will issue a credit to that credit or debit card for the amount of the canceled price.
